Robotic Process Automation: New Contractual Risks to the Enterprise

Abstract

This IDC Perspective highlights some potential risks related to the "indirect use" of software that many enterprises are not aware of and offers advice on key actions that may be taken to assess and mitigate such risks. The document explores how digital transformation (DX) and its associated technology platforms are changing how enterprises leverage and use legacy technology. Enterprises must integrate legacy with DX to make efficient use of these new innovations. However, most legacy technologies were licensed by enterprises at a time when DX and its associated technology platforms did not exist. Accordingly, the industry is struggling on how to interpret legacy license terms and apply them to new information technology architectures.

"How many other areas of potential financial exposure are there that you aren't aware of?" asks Aaron Polikaitis, VP for IDC's Executive Programs Vendor Sourcing and Management practice. "Electronic music distribution turned the music licensing industry on its head. Similarly, digital transformation is creating turmoil and forcing change in how enterprises license technology from their vendors."
